Introduction
GIS for Geologists ("G4G, "we", "us", "our", or the "Company") are committed to your privacy and the protection of your personal information online. This statement sets out the Company’s policies relating to the personal information you provide to us online. By using the www.gisforgeologists.com website ("Site") or mobile application, or submitting your personal information to us, you are agreeing to the collection, use and disclosure of personal information by G4G in accordance with this Privacy Policy.

1. What information do we collect and what do we do with it?
When you enroll as a student or subscriber on our Site, as part of the enrolling process, we collect the personal information you give us such as your name, location and email address.

Marketing Emails
From time to time, we may send you marketing emails about but not limited to our Site and related course(s), registration, course content, your course progress or other updates. We may also use your email to inform you about changes to the course, survey you about your usage, or collect your opinion. 

Testimonial Marketing
For marketing purposes, G4G may publish on our Site and mobile application or include in promotional material any formally submitted feedback or testimonial that you submit during the conclusion of any enrolled course(s). However, during this collection process, you are given the opportunity to state whether or not you give permission to G4G to use your feedback or testimonial for such marketing purposes and, if so, which (if any) personal data you wish to disclose.

Service Improvement
In order to improve our products and or services, G4G will periodically review collected personal information in bulk (e.g. most common student ages, locations etc.).

2. How do you get my consent?
When you provide us with personal information to become a student or subscriber on our Site, make a purchase, or participate in a course, you imply that you consent to our collecting it and using it for that specific reason only. 

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. 

3. How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at [email protected]

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Use

5. Thinkific Platform
Our courses and Site are hosted by Thinkific Labs Inc. ("Thinkific"). They provide us with the online course creation platform that allow us to sell our products / services to you. Your data are stored through Thinkific's data storage, databases and the general Thinkific application. They store your data on a secure server behind a firewall. 

6. Payments
If you make a purchase on our Site, we use third party payment processors such as Stripe or Paypal. Payments are encrypted through the Payment Card Industry Data Security Standard ("PCI-DSS"). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our site and related courses and its service providers.

7. Third Party Services
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. 

Certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site's Terms of Use

8. External Links
When you click on links on our Site, they may direct you away from our Site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. 

9. Security
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. 

If you provide us with your credit card information, the information is encrypted using secure socket layer technology ("SSL") and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100 % secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Introduction
These terms and conditions apply to the sale of products and services provided by GIS for Geologists ("G4G", "we", "us", "our", or the "Company") and are in addition to the "Legal Disclaimers" and "Privacy Policy" also cited on our www.gisforgeologists.com website (the "Site") and mobile application. Please read these terms and conditions carefully before purchasing any of our products or services and print off a copy for your records.

By proceeding to register an account on our Site, using the Site or purchasing any of our products or services, you bindingly agree to the following terms and conditions (the "Agreement"). If you do not agree, you must cease to continue using our Site and any products or services from us.

1. The Course
1.1 The Company shall provide access to all the courses (including the course features and associated materials listed on the Site) that are being purchased.

2. Access
2.1 In order to purchase any of the courses, you must first register an account on the G4G website. If you already have an account, you can log into your account using your username and password.

2.2 If you purchase multiple courses, each course will be treated by us as a separate product.

3. Payment
3.1 By selecting a course on the G4G website, you agree to pay the Company the fees indicated on the Site for that course.

3.2 Payment processing related to the course is performed by third party payment providers as stipulated by Sections 5 and 6 of our "Privacy Policy".

3.3 You agree to pay all fees or charges to your account in accordance with the fees, charges and billing terms in effect at the time a fee or charge is due and payable. You must provide G4G with valid payment information in connection with your orders. By providing the Company with your payment information, you agree that (i) the Company is authorised to immediately invoice your account for all fees and charges due and payable to the Company hereunder, (ii) the Company is authorised to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers, and (iii) no additional notice or consent is required for the foregoing authorisations. You agree to immediately notify the Company of any change in your payment information. If payment cannot be charged to your payment card or your payment is returned for any reason, the Company reserves the right to either suspend or terminate your access to the course(s).

3.4 When you provide payment information to the Company or to one of its payment processors, you represent to the Company that you are the authorised user of the card, PIN, key, or account associated with that payment, and you authorise the Company to charge your credit or debit card, or to process your payment with the chosen third-party payment processor for any fees incurred by you. The Company may require you to provide your address or other information to meet its obligations under applicable tax law.

3.5 If your use of the course on the Site is subject to any type of use or sales tax or value added tax ("VAT"), then the Company may also charge you for those taxes, in addition to the other fees published for that course on the G4G website.

3.6 The Company reserves the right at any time to change its prices and billing methods.

4. Limited Licence
4.1 In consideration of the fees paid by you, we grant to you a limited, non-transferable, non-exclusive, revocable licence to use the course(s) and associated materials for the sole purpose of completing the course(s).

4.2 You are granted the right to download, store and print single copies of items comprising the course and associated materials. All ownership rights in the intellectual property related to the course remain with the Company and you may not use or reproduce any of the content in any manner without the express written consent from the Company. Any violation of the copyright rights of the Company shall result in immediate termination of access to the course(s) without refund.

4.3 You agree not to use the course(s) or the G4G website to: (i) do anything that violates local, state, national or international law or breaches any of your contractual obligations or fiduciary duties; (ii) violate the Company's intellectual property; (iii) attempt to access any other user's account; (iv) reproduce, transfer, sell, resell, or otherwise misuse any course, unless specifically authorised to do so; (v) access or tamper with the Company's systems; (vi) break or circumvent our authentication or security measures or otherwise test the vulnerability of the Company's systems or networks, unless specifically authorised to do so; (vii) try to reverse engineer any portion of our courses; (viii) try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing; (ix) use any functionality of the G4G website for anything other than for completing the online course(s); and (x) impersonate or misrepresent your affiliation with any person or entity.

5. Course Terms
5.1 You shall have one licence to access and use the course under this Agreement.

5.2 You shall have lifetime access to the course(s) purchased by you under this Agreement. However, we reserve the right to revoke any licence to access and use any of our courses at any point in time in the event that we decide or are obligated to disable access due to legal or policy reasons.

5.3 You may not access or use any course(s) on the G4G website or create an account for unlawful purposes. Your use of the course(s) and behaviour on our Site must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that apply to you.

5.4 You understand and agree that the course material may not be shared, copied, and or distributed to third parties. The Company reserves the right to terminate your access to the course in its sole discretion if the Company suspects that you have shared your log-in information with a third party.

5.5 You accept that you will not have any recourse against the Company if the G4G website and or any course(s) are down, either for planned or unplanned maintenance.

5.6 After completion of the course(s), you shall receive a certificate evidencing your participation and completion.

6. Intellectual Property
6.1 All intellectual property rights of our courses' content and associated materials are and remain the intellectual property of GIS for Geologists, whether adapted, written for or customised for the client or not. Under no circumstances are you authorised to:
a. copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the course content or associated materials without prior written permission;
b. record on video or audio tape, relay by videophone or other means the course content or associated materials;
c. use the course content or associated materials in the provision of any other course or training whether given by us or any third party trainer.

6.2 Where appropriate to do so, industrial datasets used in our courses have been sufficiently modified from their original forms (e.g. size, shape, scale, orientation, coordinate reference system etc.).

7. Confidentiality
7.1 All intellectual property rights of our courses' content and associated mater

8. Liability
8.1 The Company is not responsible for any suspension or interruption of the Course and or the Site or any other part of the system due to force majeure and other factors.
8.2 The Company does not guarantee that the system is stable and uninterrupted.
8.3 The Company will only provide you with the service based on its current function and current status and reserves the right to modify all or part of each service function at any time.
8.4 No part of the products and services provided shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment advice.
8.5 Whilst the Company uses our best endeavours to ensure all of your data are secure, we will not be liable for loss of profits, contracts, or data, damage to your computer hardware or software, loss of business, loss of goodwill, reputation, revenue, anticipated savings, business opportunity, use, or consequential loss arising out of or in connection with this Site or the information or data contained within.
8.6 No claim may be brought more than six (6) months after the first date on which the product or service was purchased.

9. User Warranty
9.1 The party receiving products or services from G4G warrants that they are not an agent, employee, associate or affiliate of any competitor online geographical information systems course provider and that the Site, course content and associated materials are used solely for the purpose of meeting their own learning objectives.

10. Termination
10.1 G4G shall be entitled to terminate this Agreement and cease to provide you with any products and services with immediate effect and without liability in the event that you:
a. fail to pay fees when due;
b. act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of G4G;
c. steal or act in a fraudulent or deceitful manner towards us or our employees;
d. intentionally or recklessly damage our property or the property of employees;
e. commit any criminal offence against the Company or its employees;
f. are in breach of this Agreement

10.2 You shall be entitled to terminate this Agreement at any time with written notice to G4G, at which point the rights, provisions, products and services granted to you under this Agreement will be terminated.

11. Entire Agreement
11.1 This Agreement constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter. Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this Agreement. Each party agrees that it shall have no claim for innocent or negligent misrepresentation based on any statement in this Agreement.

12. Force Majeure
12.1 Neither party shall be in breach of this Agreement nor liable for delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure result from events, circumstances or causes beyond its reasonable control, including but not limited to, fires, floods, earthquakes, volcanoes, tsunamis, terrorism, war, severe political instability, sanctions, strikes, illness, or death. In such circumstances, the time for performance shall be extended by a period equivalent to the initially agreed-upon duration for performance of the obligation. If the period of delay or non-performance continues for one (1) month, the party not affected may terminate this Agreement by giving written notice of one (1) week to the affected party.

13. Variation
13.1 No variation of this Agreement shall be effective unless it is in writing and signed by the involved parties (or their authorised representatives).

14. Applicable Law
14.1 All parties shall use all reasonable endeavours to resolve any dispute amicably and in good faith. These terms and conditions are governed by and are to be construed in accordance with the laws of England and Wales.

15. Notices
15.1 Any email shall be deemed to have been duly given if, after one (1) hour after sending, no automated response has been received by the sender stating that the addressee's email address is invalid or that the message could not be delivered.
